Welcome to the website of TX MADE ROYALTY LLC ("Company," "we," "us," or "our"), which provides services under the name Le Frenchie Yoga. These Terms of Use ("Terms") govern your access to and use of our website located at www.lefrenchieyoga.com (the "Website") and our services, including participation in our events. By accessing or using our Website and services, you agree to these Terms. If you do not agree, you may not use our Website or services.

1. Acceptance of Terms

1.1 Binding Agreement: By accessing or using our Website and purchasing tickets for our events, you accept and agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions referenced herein.

1.2 Eligibility: You must be at least 18 years old to purchase tickets. Participants under 18 may attend only as described in Section 6 (Minors).

2. Ticket Purchases and Refund Policy

2.1 Final Sale: All ticket purchases are final and non-refundable.

2.2 Rescheduling: You may request a reschedule of an individual ticket up to three (3) days after your missed event due to an illness by contacting us at joann@lefrenchieyoga.com. Rescheduling is subject to availability and not guaranteed.

2.3 Event Cancellations: We reserve the right to cancel or reschedule events due to unforeseen circumstances, including but not limited to weather, venue issues, or insufficient participation. In such cases, you may receive a credit for a future event as described in Section 4.1.

2.4 Billing Name: All purchases are processed by TX MADE ROYALTY LLC. Charges will appear on your bank or credit card statement under TX MADE ROYALTY LLC, not Le Frenchie Yoga.

3. Private, Corporate, and Group Bookings

3.1 Scope: This section applies to private sessions, custom sessions, corporate events, birthdays, celebrations, and other group bookings ("Group Bookings"). Where this section conflicts with Section 2, this section controls for Group Bookings.

3.2 Deposit: A non-refundable deposit of twenty percent (20%) of the total booking price is due on the day of your consultation to reserve your event date.

3.3 Final Payment: The remaining balance is due in full on the day your booking is confirmed. Your event date is not secured until full payment has been received.

3.4 Session Length: Social sessions run sixty (60) minutes. Private and custom events are booked and priced by puppy hours, meaning time spent with the puppies, from one (1) to four (4) puppy hours. Events longer than one (1) hour include required thirty (30) minute puppy rest breaks after every sixty (60) minutes of puppy time. Rest breaks are included at no charge, so total event time may be up to five and one-half (5.5) hours.

3.5 Group Size: There is no minimum number of guests for Group Bookings. In-house sessions accommodate up to twenty-two (22) guests per one-hour session.

3.6 Large Group Events: Large group events are puppy socialization sessions only and do not include a yoga class. For groups larger than twenty-two (22) guests, guests will rotate through in fifteen (15) minute increments of up to twenty-two (22) guests each. Large group events follow the same puppy hour and rest break schedule described in Section 3.4. Rest breaks are required for the health and wellbeing of the puppies and cannot be shortened or waived.

3.7 Guest Count: You will be charged for the number of guests confirmed at the time of booking, even if fewer guests attend.

3.8 No Cancellations or Rescheduling: Group Bookings cannot be cancelled or rescheduled once confirmed, including when individual guests are unable to attend due to illness. All payments for Group Bookings are final and non-refundable. This does not affect our right to cancel or reschedule under Section 2.3.

3.9 Off-Site Events: We may travel to your location for Group Bookings. Travel fees vary based on distance and circumstances and will be quoted before your booking is confirmed. You are responsible for providing a safe, clean, and suitable space for the puppies and guests. We may decline to hold, or may end, a session at any location we determine is unsafe for the puppies or participants, without a refund.

4. Credits and Transfers

4.1 Credits: Credits issued by the Company, including credits for events we cancel or reschedule under Section 2.3, expire six (6) months from the date of issue. Credits have no cash value, cannot be refunded, and will not be replaced once expired.

4.2 Individual Ticket Transfers: You may transfer your individual ticket to another person if you are unable to attend. The new ticket holder must meet all participation requirements in these Terms, including the minimum age, and must sign the liability waiver before entering the puppy area. Please notify us of the transfer by emailing joann@lefrenchieyoga.com before the session.

4.3 Group Booking Substitutions: Group Booking clients may substitute one guest for another, as long as the total number of guests does not change. Substitute guests must meet all participation requirements in these Terms and must sign the liability waiver before entering the puppy area.

5. Participation Requirements

5.1 Waiver Requirement: All participants must sign a liability waiver prior to participating in any event. Refusal to sign the waiver will result in the forfeiture of your ticket without refund.

5.2 Arrival Time: Participants are expected to arrive on time. Late arrivals may not be admitted and will not receive a refund or reschedule.

5.3 Behavior: Participants must follow all event rules and instructions provided by our staff to ensure the safety and enjoyment of all attendees.

6. Minors

6.1 Minimum Age: Participants must be at least eight (8) years old to join any puppy or yoga activity. Children under eight (8) may wait outside the puppy area but must remain with and be supervised by their parent or legal guardian at all times. Children under eight (8) may not enter the puppy area or interact with the puppies.

6.2 Tickets: Every participant in the puppy area requires a ticket, including minors and any adults accompanying or supervising them in the puppy area.

6.3 Parent or Guardian Supervision: Participants age fifteen (15) and under must be accompanied by a parent or legal guardian who remains in the room for the entire session. Participants ages sixteen (16) and seventeen (17) may attend without a parent or guardian present, but a parent or legal guardian must sign the liability waiver on their behalf before the session.

6.4 Adult-to-Child Ratio: For sessions and events with multiple minors, including birthday parties, at least one (1) adult must be present for every ten (10) minors. We may refuse admission or end a session without a refund if this ratio is not met.

6.5 Participation: Minors may participate in all yoga and puppy activities. Participants of all ages must remain seated while holding a puppy.

6.6 Parent and Guardian Responsibility: Parents and legal guardians are responsible for the behavior of their minors at all times and are liable for any damage, injury, or loss caused by their minors, including injury to the puppies, other participants, or staff, and damage to Company property.

7. Nature of Services

7.1 Not Therapy or Medical Care: Our sessions are recreational relaxation and fitness activities only. They are not therapy, counseling, or medical, psychological, or mental health treatment, and they are not a substitute for professional care. No statement on our Website or at our events should be understood as a promise of any health or therapeutic benefit.

7.2 Yoga Instruction: Yoga portions of our sessions are led by certified yoga instructors.

7.3 Optional Participation: Yoga is optional. Participants may modify any pose or skip the yoga entirely and simply enjoy time with the puppies. Participants are responsible for moving within their own comfort level and abilities.

7.4 Pregnancy: Pregnant participants may take part in the yoga portion of a session only if their doctor has recommended or approved it. Pregnant participants who have not received this approval are welcome to enjoy the puppies without joining the yoga.

8. Puppy Interaction and Breed Information

8.1 Resident Puppies: Unless a specific breed has been requested and confirmed, all sessions feature the Company's resident French Bulldog puppies. Our resident puppies are periodically replaced with new French Bulldog litters as they age out of the program, so the individual puppies at your session may differ from those shown on our Website.

8.2 Puppy Attendance: A minimum of seven (7) and a maximum of eight (8) puppies will be present at each session. The specific puppies in attendance may vary to allow for rest, veterinary care, and the overall health and wellbeing of the animals.

8.3 Breed Requests: Participants may request a specific breed for any session type. Breed requests must be submitted at least four (4) weeks before the desired session date. Additional fees apply to breed requests, vary by breed, and will be provided at the time of the request. A booking with a breed request is not confirmed until the Company has secured the requested breed. If the requested breed cannot be secured, the Company will offer the participant either a session with our resident puppies or an alternative date.

If a confirmed breed becomes unavailable due to circumstances beyond our control, such as illness, we will offer the participant a session with our resident puppies, including a refund of any breed request fee, or a rescheduled session with the requested breed, subject to availability.

8.4 Allergies and Sensitivities: Participants are responsible for managing any allergies or sensitivities they may have to animals. We are not liable for allergic reactions or similar issues.

9. Puppy Care Rules

The health and safety of our puppies come first. All participants must follow these rules and any instructions from our staff.

9.1 Before Entering: All participants must remove their shoes outside the puppy area and sanitize their hands before entering.

9.2 Holding Puppies: Participants may pick up puppies only while seated and must remain seated at all times while holding a puppy. To move a puppy or visit with one outside your reach, please ask a staff member for help. Participants may not carry puppies while standing or walking.

9.3 Prohibited Behavior: Running, chasing, and rough play are not allowed in the puppy area. Participants may not feed puppies or give them treats unless the treats are provided by our staff.

9.4 Food and Drinks: Only bottled water is allowed in the puppy area.

9.5 Puppy Rest and Wellbeing: Staff may remove any puppy from a session at any time if it appears tired, stressed, or unwell.

9.6 No Outside Pets: Participants may not bring pets to any session or event.

9.7 Illness: Participants who are sick, or who have recently been around sick animals, may not attend. If you purchased an individual ticket and missed your session due to illness, you may request to reschedule by emailing joann@lefrenchieyoga.com within three (3) days of the missed session. Rescheduled sessions must take place within sixty (60) days of the original session date and are subject to availability. This exception does not include refunds and does not apply to Group Bookings or to individual guests attending as part of a Group Booking.

9.8 Removal: Staff may remove any participant who does not follow these rules or staff instructions. Participants removed for violating these rules will not receive a refund, credit, or reschedule.

10. Photography, Video, and Media

10.1 Company Photos and Video: The Company may photograph and record video during sessions and events. By entering the puppy area, you grant the Company permission to use photos, video, and recordings that include your image, likeness, or voice on our Website, social media, advertising, and other marketing materials, without payment or further notice.

10.2 Opting Out: If you do not want to appear in Company photos or video, you must tell a staff member at check-in. We will make reasonable efforts to avoid featuring you in content we publish.

10.3 Removal Requests: If you appear in content published by the Company and would like it removed, contact us at joann@lefrenchieyoga.com. We will remove the photo or edit the video to exclude you within a reasonable time. We cannot remove content already printed or distributed, or content posted by third parties.

10.4 Minors: Parents and legal guardians will be asked on the liability waiver whether they give permission for their minor to appear in Company photos and video. A parent or guardian may also object by telling a staff member at check-in. If no objection is made on the waiver or at check-in, the parent or guardian grants the Company permission to use images of the minor as described in Section 10.1.

10.5 Guest Photos and Video: Guests may take photos and video, including with flash, during sessions. By entering the puppy area, you acknowledge that other guests may photograph or record you. We ask guests to respect others' privacy, but the Company does not control and is not responsible for photos or video taken or shared by other guests.

10.6 Social Media: We encourage you to share your experience and tag us on social media. By tagging the Company or using our business name or hashtags, you grant us permission to repost, share, and feature your content on our Website and social media with credit to you.

11. Personal Belongings

11.1 Storage: A storage area is available outside the puppy area for shoes, bags, coats, and other personal items. The storage area is not supervised, and you store items there at your own risk.

11.2 Items in the Puppy Area: Please leave all personal belongings in the storage area, except for your phone or camera and bottled water.

11.3 Damage and Loss: Puppies may chew, scratch, or have accidents. The Company is not responsible for any loss, theft, or damage to personal belongings, including clothing and items brought into the puppy area.

11.4 Lost and Found: Items left behind will be held for thirty (30) days. To claim an item, email joann@lefrenchieyoga.com. Unclaimed items will be donated or discarded after thirty (30) days.

12. User Conduct

12.1 Prohibited Activities: You agree not to:

• Use the Website for unlawful purposes or in violation of these Terms.

• Disrupt the operation of the Website or access it using automated means.

• Engage in behavior at events that may harm others, our staff, or the puppies.

13. Intellectual Property

13.1 Ownership: The Website and its content, including but not limited to text, images, graphics, logos, and trademarks, are the intellectual property of the Company or its licensors and are protected under U.S. copyright and trademark laws.

13.2 Restricted Use: You may not reproduce, distribute, or create derivative works from any Website content without our prior written permission.

14. Limitation of Liability

14.1 Participation Risks: By attending our events, you acknowledge and assume all risks associated with interacting with puppies and participating in physical activities.

14.2 Liability Disclaimer: To the maximum extent permitted by law, the Company is not liable for any injuries, damages, or losses arising from your use of our Website or participation in our events.

14.3 Indemnification: You agree to defend, indemnify, and hold harmless the Company and its owners, employees, instructors, and contractors from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of the Website, your participation in our events, your violation of these Terms, or the actions of any minor or guest for whom you are responsible.

15. Dispute Resolution

15.1 Governing Law: These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

15.2 Arbitration Agreement: Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Collin County, Texas.

15.3 Class Action Waiver: You agree that any dispute will be resolved on an individual basis only. You waive any right to bring or participate in a class action, collective action, or representative proceeding against the Company.

16. Modifications and Termination

16.1 Changes to Terms: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Website. Continued use of the Website or participation in events constitutes acceptance of the modified Terms.

16.2 Termination: We may terminate or suspend your access to the Website or events at our discretion, without notice, for conduct that violates these Terms or is otherwise harmful.

17. General Provisions

17.1 Force Majeure: The Company is not liable for any delay, cancellation, or failure to perform caused by events beyond our reasonable control, including severe weather, natural disasters, illness or injury affecting our puppies or staff, government orders, public health emergencies, power outages, or venue issues. In such cases, you may receive a credit as described in Sections 2.3 and 4.1.

17.2 Severability: If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17.3 Entire Agreement: These Terms, our Privacy Policy, and the liability waiver you sign before participating make up the entire agreement between you and the Company regarding the Website and our services, and they replace any prior agreements or communications.

17.4 No Waiver: If we do not enforce any part of these Terms, it does not mean we give up our right to enforce it later.
