This Participant Waiver and Release of Liability ("Waiver") is between the participant named below (and, for minors, their parent or legal guardian) and TX MADE ROYALTY LLC, which provides services under the name Le Frenchie Yoga (the "Company"). It applies to every session, class, and event I attend with the Company, whether at the Company's location or off-site, including puppy yoga, puppy socialization, and private or group events ("Activities").

This Waiver works together with the Company's Terms of Use at www.lefrenchieyoga.com, which I have read and agree to.

2. Assumption of Risk

I understand that the Activities involve live animals and physical movement, and that they carry risks that cannot be fully eliminated even with reasonable care. These risks include, but are not limited to:

  • Bites, nips, scratches, jumping, and other unpredictable puppy behavior

  • Illnesses or conditions that can pass from animals to people, such as ringworm, parasites, or bacterial infections

  • Allergic reactions to puppies, their fur, dander, or saliva, or to cleaning products

  • Puppy accidents, such as urine or feces, on my body, clothing, or belongings

  • Slips, trips, and falls, including on mats or floors

  • Muscle strains, sprains, and other injuries from yoga or physical movement

  • Injuries caused by other participants

  • Loss, theft, or damage to my personal belongings

  • Conditions at off-site event locations that the Company does not control

I KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF THEY ARISE FROM THE NEGLIGENCE OF THE RELEASED PARTIES (DEFINED BELOW).

3. Health and Participation

By signing this Waiver, I confirm that:

  • I am responsible for my own health and for knowing my physical limits.

  • Yoga is optional. I may modify any pose or skip the yoga and simply spend time with the puppies.

  • I am responsible for managing any allergies or sensitivities I have to animals.

  • If I am pregnant, I will join the yoga portion only if my doctor has recommended or approved it.

  • I will not attend if I am sick or have recently been around sick animals.

  • The Activities are recreational relaxation and fitness activities only. They are not therapy, counseling, or medical, psychological, or mental health treatment, and the Company has not promised me any health or therapeutic benefit.

4. Release of Liability

"Released Parties" means TX MADE ROYALTY LLC (Le Frenchie Yoga) and its owners, members, employees, instructors, contractors, volunteers, and agents, and the owners of any location where Activities take place.

TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, AND LIABILITY FOR INJURY, ILLNESS, DEATH, OR LOSS OR DAMAGE TO PROPERTY ARISING FROM OR RELATED TO MY PARTICIPATION IN THE ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES. I AGREE NOT TO SUE THE RELEASED PARTIES FOR ANY CLAIM I HAVE RELEASED.

5. Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from my participation, my violation of the Company's rules or Terms of Use, or any injury or damage I cause to other people, the puppies, or Company property.

6. Rules and Removal

I agree to follow all Company rules and staff instructions, including the Puppy Care Rules in the Terms of Use. I understand that I must remove my shoes, sanitize my hands, and remain seated while holding a puppy. Staff may remove me from any Activity if I do not follow the rules, and I will not receive a refund, credit, or reschedule.

7. General Terms

Governing Law and Disputes: This Waiver is governed by the laws of the State of Texas. Any dispute will be resolved through binding arbitration in Collin County, Texas, on an individual basis, as described in the Terms of Use.

Severability: If any part of this Waiver is found unenforceable, the rest remains in full effect, and the unenforceable part will be limited only as much as necessary.

Duration: This Waiver applies to my current session and all future Activities with the Company unless I revoke it in writing.

8. Emergency Medical Care

If I am injured or become ill during an Activity and cannot make my own decisions, I authorize the Company to contact emergency services and my emergency contact. I understand that the Company is not required to provide medical care, and I am responsible for the cost of any emergency treatment or transport I receive.

9. Photo and Video Consent

The Company photographs and records video during Activities and may use them on its website, social media, and advertising, as described in the Terms of Use. Other guests may also take photos and video.

Adult participants: By signing, I give the Company permission to use my image, likeness, and voice in its photos and video without payment. If I do not want to be featured, I will check the box below and tell staff at check-in.

  • I do NOT want to appear in Company photos or video.

Minor participants (parent or guardian completes): Please check one.

  • I GIVE permission for my minor to appear in Company photos and video.

  • I DO NOT give permission for my minor to appear in Company photos and video.

I understand I can ask the Company to remove published photos or video of me or my minor by emailing joann@lefrenchieyoga.com.

10. Minors

Complete this section if the participant is under 18. Participants must be at least eight (8) years old to enter the puppy area.

I am the parent or legal guardian of the minor named below. I have read this Waiver and agree to it on my own behalf and on behalf of my minor. I understand and agree that:

  • My minor may participate in all yoga and puppy activities, and I accept the risks described in Section 2 on their behalf.

  • If my minor is fifteen (15) or younger, I will remain in the room for the entire session.

  • I am responsible for my minor's behavior and will make sure they follow all rules, including remaining seated while holding a puppy.

  • I will indemnify and hold harmless the Released Parties from any claims made by or on behalf of my minor, and I am responsible for any injury, damage, or loss my minor causes.
